Terms of Service
These terms set out the conditions for using the Newstar Clinic website and the other online services the Clinic provides, such as messenger consultations.
This is a translation of the Korean terms. If the two differ, the Korean version prevails.
Article 1 (Purpose)
These terms set out the conditions and procedures for using the website operated by Newstar Clinic (the "Clinic") at newstarclinic.co.kr and its related online services (the "Services"), and the rights, obligations and responsibilities of the Clinic and its users.
Article 2 (Definitions)
- "Services" means the online services the Clinic provides through its website, messengers (Instagram, Facebook Messenger, WhatsApp and others), its WeChat mini program and similar channels, including information on treatments and procedures, online reservations, consultation requests and event announcements.
- "User" means any member or non-member who uses the Services under these terms.
- "Member" means a person who has registered as a member by providing personal information to the Clinic.
- Terms not defined here follow the relevant laws and general practice.
Article 3 (Posting and Amendment of the Terms)
① The Clinic posts these terms on its website where users can easily find them.
② The Clinic may amend these terms within the limits of the relevant laws. It announces amendments on the website, with the effective date and the reason, at least 7 days before they take effect, or at least 30 days before if the change is unfavourable to users.
③ Users who do not agree to the amended terms may stop using the Services and cancel their membership. Continuing to use the Services after the announced effective date is treated as agreement to the amended terms.
Article 4 (The Services)
The Clinic provides the following Services:
- Information about the Clinic, its doctors, treatments and procedures, prices and aftercare
- Online reservations and consultation requests
- Consultations through messengers (Instagram, Facebook Messenger, WhatsApp and others)
- Events and promotions, notices, columns and other information
- Member services such as sign-up and log-in
- Any other services the Clinic decides to provide
Article 5 (Membership and Withdrawal)
① A user applies for membership by agreeing to these terms and the Privacy Policy and entering the requested information. Membership is formed when the Clinic accepts the application.
② The Clinic may refuse an application, or later restrict membership, in the following cases:
- Someone else's name or information, or false information, was used
- The applicant is a minor (under 19) and has not obtained the consent of a parent or legal guardian
- The applicant previously lost membership for breaching these terms
- Any other breach of the relevant laws or these terms
③ Members may withdraw at any time using the withdrawal function on the website or by phone or email, and the Clinic will process the request without delay. Information that must be kept by law, such as medical records under the Medical Service Act, is kept for the required period.
Article 6 (Online Reservations and Consultations)
① An online reservation is not confirmed by the request alone. It is confirmed once the Clinic has checked its schedule and contacted you. If the requested time is not available, the Clinic may suggest another time.
② Please let us know in advance by phone or through a consultation channel if you need to change or cancel a reservation.
③ Answers given on the website or through messenger consultations are general information and do not replace an examination by a doctor. Diagnosis, whether a procedure is suitable and how it is done are decided after you visit and see a doctor.
④ Messenger consultations take place on services run by the messenger operators, so their own terms and policies also apply to you.
⑤ Treatment of minors (under 19) requires the consent of a parent or legal guardian. The guardian consent form (Minor Consent Form) can be downloaded at the bottom of the website; please fill it in and bring it to your visit.
Article 7 (Treatment Information and Events)
① Results and before-and-after photos shown on the website vary from person to person, and any procedure can have side effects. Please discuss the details with a doctor during your consultation.
② Prices and the content, period and conditions of events may change or end early, and changes are announced on the website. Where an event has its own conditions, those conditions take precedence.
Article 8 (Users' Obligations)
Users must not:
- Enter false information or use someone else's information when making a reservation, requesting a consultation or signing up
- Alter information posted by the Clinic, or copy, distribute or commercially use it without the Clinic's consent
- Infringe the intellectual property rights or reputation of the Clinic or any third party
- Interfere with the Services through repeated false reservations, malicious software, abnormal access or similar means
- Send obscene or violent messages or advertising
- Do anything else that breaks the relevant laws
Article 9 (The Clinic's Obligations)
① The Clinic complies with the relevant laws and these terms and makes every effort to provide the Services reliably.
② The Clinic publishes and follows a Privacy Policy to protect users' personal information. The collection, use, retention and destruction of personal information are governed by the Privacy Policy.
Article 10 (Copyright)
Copyright in the text, photos, videos, designs and other content created by the Clinic and posted on the website belongs to the Clinic. Users may not reproduce, transmit, publish, distribute or broadcast it for commercial purposes, or let third parties do so, without the Clinic's prior consent.
Article 11 (Changes to and Suspension of the Services)
① The Clinic may change or suspend all or part of the Services for operational or technical reasons, and will announce this on the website in advance, or afterwards where that is unavoidable.
② The Clinic may temporarily suspend the Services for maintenance or replacement of equipment, communication failures, natural disasters and similar reasons.
Article 12 (Limitation of Liability)
① The Clinic is not liable for failing to provide the Services for reasons beyond its control, such as natural disasters, communication failures or outages of third-party services including messenger operators.
② The Clinic is not liable for problems or losses caused by the user's own fault.
③ The information on the website is for general guidance. The Clinic's responsibility for medical treatment and procedures is governed by the Medical Service Act and other relevant laws.
Article 13 (Dispute Resolution and Jurisdiction)
① The Clinic and users will consult in good faith to settle any dispute about the Services. Medical disputes may be referred for mediation to the Korea Medical Dispute Mediation and Arbitration Agency.
② These terms are governed by the laws of the Republic of Korea, and lawsuits about the Services are brought before the court with jurisdiction under the Civil Procedure Act.
